2. Information We Collect

When you register for our Rate Watch program, we collect the following categories of personal information:

Contact Information

• First and last name
• Email address
• Phone number

Loan & Financial Information

• Current mortgage interest rate
• Target interest rate threshold
• Estimated loan balance
• Loan type (e.g., FHA, Conventional, VA, USDA)

Property Information

• Property street address, city, state, and ZIP code

Consent Records

• Date, time, and IP address of form submission
• Record of consents provided (marketing communications, TCPA telephone consent)

We do not collect Social Security numbers, credit card numbers, bank account numbers, or government-issued ID numbers through this form.

3. How We Use Your Information

We use the information you provide for the following purposes:

• Rate Watch Alerts: To monitor interest rate changes and contact you when rates reach your specified target threshold.
• Marketing Communications: To send you information about refinancing opportunities, mortgage products, and related services offered by Providence South Mortgage, LLC — but only if you have provided express consent to receive such communications.
• Service Communications: To confirm your enrollment in the Rate Watch program, respond to inquiries, and provide program updates.
• Compliance & Record-Keeping: To maintain records of your consents and communications as required by applicable law, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and applicable state regulations.
• Internal Operations: To improve our services and better understand the needs of prospective clients.

We will not use your information for any purpose that requires additional consent beyond what you provided at the time of registration without first obtaining that consent.

4. Legal Basis for Processing

We process your personal information on the following legal bases:

• Consent: You have given express written consent to receive marketing communications and to be contacted by phone or text message regarding our services.

• Lending Partners & Lenders: If you proceed with a refinance inquiry, we may share relevant information with wholesale lenders and other parties necessary to process your mortgage application. Any such sharing will be done in accordance with applicable law and disclosed to you at that time.
• Service Providers: We may share information with third-party vendors who assist us in operating our website, delivering communications, or managing our business — including form processing platforms (e.g., Netlify) and email service providers. These vendors are contractually prohibited from using your information for any other purpose.
• Legal Requirements: We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Providence South Mortgage, its clients, or the public.
• Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our business assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control.

6. Marketing Communications & Your Opt-Out Rights

By providing your consent on the Rate Watch registration form, you authorize us to contact you via email, phone, and/or text message. Your consent is not a condition of obtaining any mortgage loan or service.

How to Opt Out

• Email: Click the "Unsubscribe" link in any marketing email, or email us directly at claycooke@provsouth.com with the subject line "Unsubscribe."
• Phone/Text: Reply STOP to any text message, or call or email us to request removal from our call list.
• All Communications: Send a written request to claycooke@provsouth.com. We will process your request within 10 business days.

Please note that opting out of marketing communications does not remove you from transactional or legally required communications (e.g., responses to your direct inquiries).

7. Telephone Consumer Protection Act (TCPA)

By providing your phone number and checking the TCPA consent box on our registration form, you expressly consent to receive autodialed or pre-recorded calls and text messages from Providence South Mortgage, LLC at the phone number you provided, even if that number is listed on a federal or state Do Not Call registry.

You may revoke this consent at any time by contacting us in writing at claycooke@provsouth.com. Revoking TCPA consent does not affect the lawfulness of any communications made before revocation.

8. CAN-SPAM Compliance

All marketing emails we send comply with the CAN-SPAM Act. Each email will:

• Clearly identify Providence South Mortgage, LLC as the sender
• Include our valid physical mailing address
• Include a clear and conspicuous opt-out mechanism
• Honor opt-out requests within 10 business days
• Not use deceptive subject lines or misleading header information

9. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, or as required by applicable law. Specifically:

• Rate Watch registrations are retained for a period of up to 3 years from the date of enrollment or until you request deletion, whichever comes first.
• Consent records are retained for a minimum of 5 years to comply with TCPA and regulatory requirements.
• If you proceed with a mortgage application, loan records are retained in accordance with applicable federal and state mortgage lending regulations (generally 3–7 years).

10. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, disclosure, alteration, or destruction. These include:

• Secure HTTPS transmission of all form data
• Access controls limiting who within our organization can view your information
• Use of reputable third-party form and data processors with their own security standards

However, no method of transmission over the Internet is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. In the event of a data breach that affects your personal information, we will notify you as required by applicable law.

11. Your Rights

Depending on your state of residence, you may have the following rights regarding your personal information:

• Right to Access: Request a copy of the personal information we hold about you.
• Right to Correction: Request that we correct inaccurate or incomplete information.
• Right to Deletion: Request that we delete your personal information, subject to legal retention requirements.

13. Children's Privacy

Our Rate Watch program is intended for adults 18 years of age or older. We do not knowingly collect personal information from individuals under the age of 18. If we become aware that we have inadvertently collected information from a minor, we will delete it promptly.

14. Third-Party Links

Our website may contain links to third-party websites (e.g., NMLS Consumer Access). This Privacy Policy does not apply to those sites. We encourage you to review the privacy policies of any third-party sites you visit.

15. Changes to This Privacy Policy

We encourage you to review this page periodically. Continued use of our Rate Watch program after any changes constitutes acceptance of the updated policy.

16. Regulatory Disclosures

Providence South Mortgage, LLC is a licensed mortgage broker. We are not a mortgage lender and do not make credit decisions. Mortgage products are subject to credit approval, income verification, property appraisal, and other underwriting conditions. Rate Watch alerts are informational only and do not constitute a loan commitment, pre-approval, or guarantee of any specific interest rate or loan terms.

We are subject to the following regulatory frameworks: the Equal Credit Opportunity Act (ECOA), the Fair Housing Act, the Real Estate Settlement Procedures Act (RESPA), the Truth in Lending Act (TILA), and applicable Alabama state mortgage lending laws.
